Terms of Service

These Terms of Service (the "Terms") govern your use of the Simulation Baseball website at simulationbaseball.com and the Simulation Baseball game at play.simulationbaseball.com (together, the "Service"). By joining the waitlist, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by Internet Businesses LLC, a Wyoming limited liability company ("we," "us," or "our"). You can reach us at [email protected].

2. Beta status

Simulation Baseball is currently an invited beta. Access is granted at our discretion and may be paused, limited, or revoked at any time. Features, rules, balance, and data models will change frequently and without notice while the game is in beta.

Beta leagues, franchises, saves, and statistics will be wiped before the 1.0 release. Nothing you build during the beta is guaranteed to carry over. Please treat all beta progress as temporary.

3. Eligibility

You must be at least 16 years old to join the waitlist, create an account, or use the Service. By using the Service, you represent that you meet this requirement.

4. Your account

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us right away at [email protected] if you believe your account has been compromised.

5. Acceptable use

When using the Service, you agree not to:

• Cheat, exploit bugs for competitive advantage, or manipulate league outcomes in bad faith;
• Use bots, scripts, scrapers, or other automated means to access the Service or harvest data from it;
• Attempt to probe, disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
• Reverse engineer, decompile, or copy the game, its simulation engine, or its data, except where the law allows it despite this restriction;
• Harass, threaten, or abuse other managers, or post unlawful, hateful, or infringing content in league messaging or anywhere else on the Service;
• Impersonate another person or misrepresent your affiliation with anyone;
• Sell, rent, or transfer your account or beta access to anyone else.

We may suspend or terminate accounts that violate these rules, remove offending content, and take reasonable steps to protect the Service and its community.

6. Your content and feedback

You keep ownership of the content you submit to the Service, such as league names, team names, and messages. You grant us a worldwide, royalty-free license to host, display, and use that content as needed to operate the Service. If you send us feedback, suggestions, or bug reports, we may use them without restriction or compensation.

7. Our intellectual property

The Service, including the game, the simulation engine, the site, and all related content, design, and branding, is owned by Internet Businesses LLC or its licensors. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted.

8. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access at any time, including for violations of these Terms or as part of beta operations (for example, the pre-1.0 wipe described above). Sections that by their nature should survive termination, including Sections 6, 7, 9, 10, and 11, will survive.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be preserved. This is beta software; expect rough edges.

10. Limitation of liability

To the maximum extent permitted by law, Internet Businesses LLC and its members, managers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to the Service. To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed one hundred US dollars (USD 100) or, if greater, the amount you paid us for the Service in the twelve months before the claim arose.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms as the Service evolves, especially during the beta. When we make material changes, we will update the effective date above and take reasonable steps to notify active users, such as an in-game notice or an email. Continuing to use the Service after changes take effect means you accept the updated Terms.
